Reform of the Transparency Law: Final Approval

Congress definitively approves the reform of the law on transparency, access to public information and good governance with the introduction of the Senate's amendments.

The reform proposal defends the reasons why it is necessary to amend law 19/2013 to make public the information on the participation of SMEs in public procurement.

Article 8.1 of the aforementioned regulation has been modified to include the parties that must make public the information related to administrative management acts of an economic or budgetary nature, based on the participation of micro-enterprises and SMEs in the procedures foreseen in the public sector procurement legislation.

The last paragraph of Article 8(a) is also amended, requiring the information to be published every six months.

Environment and taxation

Law 16/2013 approving measures in the field of environmental taxation and other financial and tax measures is also amended.

A new wording is given to article 5 of law 16/2013 related to the greenhouse gas tax. Paragraph twenty of the first final provision affecting gases in metered dose inhalers for the supply of pharmaceutical ingredients is also amended.

Until 31 December 2026, the manufacture, importation or intra-Community acquisition of such gases shall be exempted.
